INTELLECTUAL PROPERTY COMPLAINT POLICY

RewindEra offers a platform for users to sell their own products. By using RewindEra's services, users agree to comply with all terms and conditions. RewindEra strictly prohibits the use of its platform for selling merchandise that violates the intellectual property rights of third parties, including copyright, trademark, trade dress, and rights of publicity.

RewindEra's policy is to promptly remove any content it reasonably believes to infringe on the intellectual property rights of others, following the receipt of a valid notice, and to suspend or terminate accounts in cases of repeated violations.

If you believe that a RewindEra user is infringing on your intellectual property rights, please contact us at legal@rewindera.com with the following details:

1. A physical or electronic signature of the individual authorized to act on behalf of the owner of the intellectual property that is allegedly being infringed.
2. The URL link to the RewindEra listing(s) where the allegedly infringing merchandise is being offered.
3. Detailed identification of the copyrighted work, trademark, or other intellectual property rights that you believe have been violated, along with proof of ownership (such as copies of existing registrations).
4. Your complete contact information, including your full name, mailing address, phone number, and email address.
5. A statement affirming that you have a good-faith belief that the use of the material in question is not authorized by the rights owner, its agent, or applicable law.
6. A declaration, under penalty of perjury, that the information provided in your notice is accurate and that you have the authority to act on behalf of the owner of the intellectual property rights that have allegedly been infringed.

COUNTER-NOTICE POLICY

If you believe that an intellectual property claim against you was made in error or due to misidentification, you have the right to submit a counter-notice. Be aware that if you knowingly misrepresent in your counter-notice that your content does not infringe upon intellectual property rights, you could be held responsible for damages to the rights holder, including legal costs and attorney’s fees. If you are unsure whether your material infringes on intellectual property rights, it's strongly recommended to seek legal advice before filing a counter-notice.

To file a counter-notice, please send it to legal@rewindera.com with the following information:

1. Your physical or electronic signature.
2. Your full name, address, telephone number, and email address.
3. A description of the material and its original location before removal, including the URL or campaign number related to the RewindEra listing of the alleged infringing merchandise.
4. A statement, under penalty of perjury, that the claim of intellectual property infringement that led to the removal or blocking of access to the material was made by mistake or due to misidentification.
5. Your agreement to the jurisdiction of the federal court in the district where you reside (if you are in the U.S.) or your agreement to the jurisdiction of the federal court where your service provider is located (if you reside outside the U.S.).
6. Your consent to accept service of process from the party who filed the original takedown notice or their representative.

Upon receipt of your counter-notice, a copy may be forwarded to the party who filed the initial complaint, informing them that RewindEra may restore the removed material or cease disabling access to it within 10 business days. Unless the intellectual property owner takes legal action to prevent this, the removed content may be reinstated or access to it restored within 10 to 14 business days after the counter-notice is received.

REPEAT INTELLECTUAL PROPERTY COMPLAINT POLICY

If RewindEra receives multiple notifications indicating that you have repeatedly used others' intellectual property without authorization, we may deactivate your account. RewindEra has a process in place to monitor repeat offenders of intellectual property rights and to determine the appropriate actions, including suspending or permanently terminating accounts.

RewindEra reserves the right to close accounts that violate the spirit of our Terms of Service, regardless of the number of offenses.
